We granted a petition to review a decision and opinion of the Court of Appeals which ordered the trial court to grant summary judgment to the defendant, Governor Jack A. Williams, Commander-in-Chief of the Air National Guard of Arizona, hereinafter also referred to as the "Guard." The trial court had refused the Guards motion to dismiss the complaint of the Sunnyside School District No. 12 in which the school has asked that the Guard be permanently enjoined from using, except in an emergency, the airspace immediately above or in proximity to the school. See Williams v. Superior Court, 15 Ariz. App. 480, 489 P.2d 854 (1971).
